This privacy policy is provided in compliance with Articles 13 and 14 of the EU Regulation 679/2016 (“GDPR”) to users (“Users” or “User”) of the website www.longhimiami.com, both desktop and mobile versions (“Site”). The Site is owned by Longhi USA, located at 6101 Biscayne Blvd, Unit B, Miami, FL, 33137, serving as the Data Controller (“Longhi USA”). This document describes the management of our Site with reference to the processing of personal data, as well as informing the Users of the Site about the purposes and methods of data processing by the Data Controller in case they provide their personal data. This document will help you understand our privacy practices and how your personal information is handled when you use our services, allowing you, if necessary, to give informed and explicit consent to the processing of your personal data in sections of the site where personal data is requested. Specific disclosures in accordance with Article 13 of the GDPR are provided in various sections of the website where personal data is collected.

Data Controller

The Data Controller for processing carried out through the Site is Longhi USA, with the registered office located at 6101 Biscayne Blvd, Unit B, Miami, FL, 33137. The updated list of data processors and persons in charge of processing is kept at the registered office of the Data Controller.

Personal Data Processed

“Processing” of personal data refers to any operation or set of operations performed on personal data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure, or destruction. We inform you that the personal data processed will include identifiers such as name, email address, identification numbers, location data, online identifiers, and other data that may make you identified or identifiable, depending on the type of Services requested (“Personal Data”).

Navigation Data

The computer systems and software procedures used to operate the Site collect certain Personal Data whose transmission is implicit in the use of Internet communication protocols during their normal operation. This data is not collected to associate it with identified users, but by its very nature could, through processing and association with data held by third parties, allow users to be identified. This category includes IP addresses or domain names of computers used by users connecting to the Site, the URI addresses of the requested resources, the time of the request, the method used to submit the request to the server, the size of the file received in response, the numerical code indicating the status of the response from the server (successful, error, etc.), and other parameters relating to the user’s operating system and computer environment. This data is used only to obtain anonymous statistical information on the use of the Site and to check its correct functioning. The data could be used to ascertain responsibility in case of hypothetical computer crimes against the Site.

Data Voluntarily Provided by the User

The optional, explicit, and voluntary sending of emails to the addresses indicated on the Site involves the subsequent acquisition of the sender’s address, necessary to respond to requests, as well as any other personal data included in the message. Similarly, personal data included in web forms to access specific services (such as contact forms, newsletter subscriptions, or job applications) will be processed.

Registration Data

The Site provides certain categories of professional users (Dealers, Architects, Press) the opportunity to register and create their own accounts. The data collected by Longhi USA in the context of registration requests are strictly necessary for the provision of the service and include: Name, Surname, Company, Profession, Country, City, Email, and Phone. The provision of this data is voluntary; however, without it, Longhi USA will not be able to create the account.

Purpose of Processing

The Data Controller informs Users of the Site that the collected data will be processed lawfully pursuant to Article 6 of the GDPR, and based on your specific consent where necessary, exclusively for the following purposes:

a) Enabling the provision of Services requested by you and managing your user account autonomously;

b) Allowing browsing and consulting of Longhi USA websites;

c) Responding to requests for assistance or information received via email, phone, or the “Contact Us” page on our Site;

d) Complying with legal, accounting, and tax obligations;

e) Conducting direct email marketing for services similar to those you have subscribed to, unless you have initially objected to such processing;

f) Conducting market research, studies, and statistics;

g) Sending you advertising material, promotional communications, and satisfaction surveys via email or SMS, and/or through telephone calls or social network pages of Longhi USA; h) For security purposes and to prevent fraudulent behavior, the Data Controller implements an automatic monitoring system involving the detection and analysis of user behavior on the site associated with the processing of Personal Data, including the IP address.

Legal Basis and Voluntary Nature of Processing

The legal basis for processing Personal Data for the purposes of sections 3a, 3b, and 3c is Article 6(1)(b) of the GDPR, as the processing is necessary for the provision of contracted services. The provision of Personal Data for these purposes is voluntary, but failure to provide it may make it impossible to activate the services requested.

The purpose described in section 3d represents a legitimate processing of Personal Data under Article 6(1)(c) of the GDPR. Once Personal Data is provided, the processing may be necessary to comply with legal obligations to which Longhi USA is subject.

The processing for the purpose of marketing described in section 3g is based on the release of your consent according to Article 6(1)(a) of the GDPR. Providing your Personal Data for these purposes is entirely voluntary and does not affect the enjoyment of the services.

Recipients of Personal Data

Personal Data provided may be known and used by Longhi USA employees and/or collaborators tasked with managing the Site and user requests solely for the purpose of performing the activities for which the data was collected. Personal Data may also be communicated to third parties authorized to process it on behalf of the Data Controller, such as IT service providers, outsourcing or cloud providers, and consultants or freelancers who assist Longhi USA in providing the requested services or organizing commercial and marketing initiatives on behalf of the Data Controller. Users may obtain the list of these third-party processors upon request.

Existence of Automated Decision-Making

There is no automated decision-making process, including profiling, regarding the processing of your Personal Data.

Transfer of Personal Data

Some of your Personal Data is shared with recipients that may be outside the European Economic Area. Longhi USA ensures that the processing of your Personal Data by these recipients complies with the GDPR. Transfers are based either on an adequacy decision or on the Standard Contractual Clauses approved by the European Commission. More information can be obtained from the Data Controller.

Retention of Personal Data

Personal Data processed for the purposes of sections 3a, 3b, and 3c will be retained for the time strictly necessary to achieve those same purposes. In any case, as these processing activities are performed for the provision of Services, Longhi USA will process Personal Data up to the time permitted by Italian law to protect its interests (Art. 2946 of the Civil Code and following modifications).

Personal Data processed for the purposes described in sections 3d will be kept until the time prescribed by the specific obligation or applicable law.

For the purposes described in sections 3e and 3g, your Personal Data will be processed until you revoke your consent or until three years after you cease to be a customer of Longhi USA. However, Longhi USA may retain your Personal Data longer if Italian law allows it to protect its interests (Art. 2947 paragraphs 1 and 3 of the Civil Code).

Rights of the Data Subject

As a Data Subject, you may exercise your rights guaranteed by the GDPR regarding the processing of your Personal Data by Longhi USA. In particular, you are entitled to: a) Access your data to check whether personal data processing is ongoing and access information about the purposes of the processing, the categories of personal data processed, the recipients to whom the personal data has been or will be disclosed, the planned retention period, the existence of the right to request the correction, deletion or limitation of processing, and the right to complain to a supervisory authority; b) Request the correction of inaccurate personal data concerning you and the integration of incomplete personal data; c) Delete personal data concerning you under certain conditions; d) Restrict the processing of personal data concerning you in certain circumstances; e) Data portability, i.e., the right to receive your personal data in a structured, commonly used format readable by an automatic device, and the right to transmit that data to another Data Controller without hindrances from Longhi USA.

These rights may be exercised by sending a request to Longhi USA using the contact details provided at the beginning of this policy or through the methods indicated in the appropriate control panel for registered users.

In addition to the above rights, you always have the right to file a complaint about any issue regarding the processing of your Personal Data with the Italian Data Protection Authority (Garante per la protezione dei dati personali, www.garanteprivacy.it).
